About this website

kayhart.co.uk is operated by Kay Hart. Red Pen Editorial is the name under which editorial services are provided through the website.

Email: Kay@kayhart.co.uk

The website includes my writing, articles and creative work; The Library; The Story Cabinet; Fragmented Souls; The Enchanted Manuscript; The Editorial Desk and Red Pen Editorial; In the Margins; The Literary Community; The Bookmarked Society; The Scribblers’ Parlour; The Paper Trail; member and community features; contact and editorial enquiry forms; private script-request facilities; bookings; payments; and other related content and services.

Some material may require a member account, approved request, booking or other form of access.

Where you purchase a paid service, the trader information and other pre-contract information required for that transaction, including the applicable geographical business correspondence address, will be made available through the booking, checkout or contractual information provided before the contract is concluded and/or in the durable confirmation provided to you.

18+ website and age requirement

ayhart.co.uk is an adults-only website. You must be aged 18 or over to access or use the website.

This requirement applies to the website as a whole, including publicly viewable writing and articles, The Library, In the Margins, The Literary Community, The Scribblers’ Parlour, The Bookmarked Society, mailing lists, member areas, editorial enquiries and services, events, bookings and requests for access to private scripts or manuscripts.

Visitors may be required to confirm that they are aged 18 or over before entering the website.

You must not deliberately provide a false age confirmation, attempt to circumvent the age gate or create or use an account if you are under 18.

If I reasonably believe that a visitor or member is under 18, I may restrict or remove access, close an account, remove the person from a mailing list or community feature, cancel access to private material, or take other reasonable steps necessary to enforce this age requirement.

The fact that the website is restricted to adults does not mean that every page contains mature material. It is a site-wide access and privacy rule.

Information about age confirmation and any technology used to remember a visitor’s age-confirmation status is provided in the Privacy Policy and Cookie Policy.

Using this website

You may use kayhart.co.uk only for lawful purposes and in accordance with these Terms.

You must not use the website to break any applicable law or regulation; infringe another person’s intellectual-property, privacy or other legal rights; interfere with the security or operation of the website; attempt to gain unauthorised access to accounts, private scripts, manuscripts, systems or restricted areas; introduce malware or harmful code; impersonate another person; provide deliberately false information in connection with an account, booking, enquiry or request; harass or abuse another user; or use material obtained through the website for unlawful, fraudulent, abusive or misleading purposes.

You must not use automated systems to scrape, harvest, systematically reproduce or extract substantial amounts of website content without permission, except where applicable law expressly permits that activity.

You must not reproduce my original writing or other protected material for the purpose of creating, training or supplying a dataset or artificial-intelligence model without my permission except to the extent that such use cannot lawfully be restricted.

I may restrict access where reasonably necessary to protect the website, its users, my creative work, my business or another person’s rights.

Writing and intellectual property

Unless otherwise stated, the fiction, scripts, articles, essays, extracts, branding, graphics, photographs, page copy and other original material published on kayhart.co.uk belong to me or are used with permission.

Copyright and other intellectual-property rights continue to apply even where material can be viewed freely on the website.

You are welcome to read publicly available work, share links to it and discuss it.

You may not reproduce, republish, sell, commercially exploit, adapt, distribute, upload, substantially copy or otherwise use protected material without permission except where permitted by law.

Short quotations may be used for purposes such as review, criticism, reporting or discussion where the law permits this and appropriate attribution is given.

Nothing on this website transfers ownership of my intellectual property to you.

Private scripts and manuscripts

Some scripts, screenplays, stage plays, manuscripts and other creative work are not publicly available in full.

You may be able to request access through The Enchanted Manuscript or another private-access facility. Submitting a request does not guarantee that access will be granted.

Where access is approved, permission is limited to reading the material for the purpose for which access was granted.

Approval does not transfer copyright or give you permission to reproduce, publish, distribute, upload, sell, adapt, perform, circulate or commercially exploit the material.

You must not share private access links, passwords, files or copies with another person unless I have expressly agreed to this.

I may refuse a request or withdraw future access where reasonably necessary, including where these Terms have been breached, the access link has been shared improperly or there is a legitimate need to protect unpublished work.

Withdrawal of access does not affect rights that cannot legally be withdrawn.

Red Pen Editorial

Red Pen Editorial provides editorial services through kayhart.co.uk under the principle:

Keep your voice. Strengthen your words.

Services may include manuscript editing, developmental feedback, Editorial Consultations and other editorial support agreed between us.

The precise scope of work depends on the service selected and what is agreed before work begins.

Submitting an enquiry does not guarantee that I will accept a project.

I may decline an enquiry where I do not believe I am the appropriate editor for the work, the requested timescale is not workable, the material falls outside the services I provide, there is a conflict of interest, or another reasonable professional or legal reason applies.

Editorial enquiries

You may be asked for information about your manuscript or project, including its type, genre, word count, stage of development, the kind of support you are seeking and any relevant deadlines.

You may also be invited to provide a manuscript, extract, sample, synopsis, notes or other material.

I use this information to assess the enquiry and determine whether I can offer an appropriate service.

An enquiry alone is not a binding booking or contract.

When a service contract is formed

A contract for a paid editorial service is formed only when the relevant service, scope, price and arrangements have been confirmed and any required booking or payment step has been completed.

Before you are bound by an online purchase or booking, you will be given the information applicable to that service, including the price and any relevant cancellation or performance arrangements.

Following an online purchase or booking, you will receive confirmation in a form that can be retained, such as email or other durable electronic confirmation.

Any proposal, quotation, booking confirmation, invoice, written scope or other project-specific terms expressly agreed between us form part of the agreement for that project.

Where a project-specific term conflicts with these general Terms, the project-specific term will apply to that project to the extent of the conflict, provided it is lawful and was properly disclosed and agreed.

Proposals, scope and editorial plans

For editorial work, I may provide a proposal, quotation, invoice, booking confirmation, editorial plan or written scope describing the work to be carried out.

This may specify the service being provided, the manuscript or material covered, the fee, expected timescale, nature of the editing or feedback, any meeting or consultation and other project-specific arrangements.

You should check the agreed scope before work begins and tell me promptly if anything appears incorrect.

A substantial change to the manuscript, word count, brief, requested service or deadline after the project has been agreed may require a revised fee, scope or timetable.

I will not impose a material change to an agreed paid service without discussing it with you first and obtaining agreement where required.

Prices, invoices and payments

Prices displayed on kayhart.co.uk may be fixed fees, indicative prices or starting prices depending on the service.

Where a final price depends on manuscript length, complexity, scope or turnaround time, the applicable fee will be confirmed before you become contractually bound.

Any applicable tax or other charge will be disclosed where required.

Payments, invoices, booking transactions and related administration may be handled through Wix, Wix Bookings, Wix Payments and associated payment processors.

I do not receive or store your full payment-card details.

Where payment is required before work begins, the service will not normally be treated as confirmed until the required payment has been successfully completed unless we have agreed otherwise in writing.

You are responsible for supplying accurate booking, billing and invoicing information.

Nothing in these Terms removes or limits any statutory consumer right that cannot legally be excluded.

Consumer rights and service standards

If you purchase an editorial service as a consumer, your rights under applicable consumer law continue to apply.

Services must be provided with reasonable care and skill. Where a time for performance has not been fixed, consumer law may require the service to be performed within a reasonable time. Where a price has not been agreed in advance, consumer law may require a reasonable price.

Nothing in these Terms is intended to reduce those rights.

If a paid service does not conform to the standards required by law, you may have statutory remedies. These Terms do not replace or restrict those remedies.

Editorial Consultations

Editorial Consultations are focused one-to-one sessions intended to help you work through a manuscript, writing problem, structural issue, creative decision or next-stage plan.

The applicable consultation price will be displayed before you complete your booking.

Information supplied through your original enquiry may be used to prepare for the consultation. You may also be invited to provide extracts, notes, questions or other relevant material in advance.

Consultations may take place through Zoom, Google Meet or another mutually agreed video-conferencing platform.

Joining information will normally be provided separately.

You are responsible for having a suitable device, internet connection and environment from which to participate.

If a technical issue attributable to me or the platform prevents the consultation from proceeding, I will make reasonable efforts to resolve it or arrange an appropriate alternative.

If a technical problem is solely on your side, I will still make reasonable efforts to help, but rearrangement or refund rights may depend on the circumstances and any booking-specific terms disclosed in advance.

Consultations are not recorded by me unless you are informed beforehand and any consent required has been obtained.

A consultation provides editorial discussion, guidance and professional opinion. It does not guarantee publication, representation, sales, academic results, commercial success or any other particular outcome.

Your 14-day right to cancel

If you are a consumer and enter into a qualifying service contract online or at a distance, you will normally have a legal right to cancel the contract without giving a reason during the 14-day cancellation period.

For a service contract, that period normally begins when the contract is made.

If the law provides an exception in a particular situation, that exception will apply.

If I fail to provide information that the law requires about the cancellation right, the cancellation period may be extended as provided by law.

Starting a service during the 14-day cancellation period

You may sometimes want an Editorial Consultation or other service to begin before the 14-day cancellation period has expired.

Where the law requires it, I will only begin providing the service during that period after you have expressly requested that performance starts early.

If you then cancel before the service has been fully performed, you may be required to pay a proportionate amount for the service supplied up to the time you informed me that you wished to cancel.

If the service is fully performed during the cancellation period after you have expressly requested early performance and given any acknowledgement required by law that your cancellation right will be lost once the service is fully performed, the statutory right to cancel may end when the service has been completed.

Merely accepting these Terms does not, by itself, replace any separate express request or acknowledgement that the law requires.

How to cancel

To exercise a statutory cancellation right, you must tell me clearly that you wish to cancel.

You can do this by emailing:

Kay@kayhart.co.uk

You may use the model cancellation form at the end of these Terms, but you do not have to use it. Any clear statement communicating your decision to cancel is sufficient where the statutory right applies.

If a refund is legally due following a valid cancellation, it will be processed without undue delay and within the period required by law, normally using the same payment method unless another method is expressly agreed.

Additional cancellation, rescheduling and non-attendance terms

A particular appointment or editorial service may have additional reasonable cancellation, rescheduling or non-attendance arrangements.

Where those terms apply, they will be brought to your attention before the booking or contract is completed.

They will not override a statutory cancellation, refund or consumer right that the law requires me to provide.

If you need to cancel or rearrange a service, please contact me as soon as reasonably possible.

Client manuscripts and materials

You retain ownership of manuscripts, scripts, extracts, synopses, notes and other creative material you provide to Red Pen Editorial.

Sending material to me does not transfer copyright or ownership.

You give me permission to access, review, annotate, edit, store and otherwise process that material only to the extent reasonably necessary to assess your enquiry, carry out the agreed service, communicate with you about it or meet applicable legal obligations.

You are responsible for ensuring that you have the right to provide any material you submit.

Please do not provide another person’s unpublished work unless you have appropriate permission or authority.

Confidentiality

I treat unpublished manuscripts and other private creative material supplied for editorial work as confidential.

I will not knowingly publish, distribute or disclose your manuscript to unrelated third parties without permission.

Information or files may, however, be technically processed, stored or transmitted by service providers used to operate the editorial service, including website, email, cloud-storage, booking, payment or communications providers, where reasonably necessary.

Information may also be disclosed where legally required or necessary to establish, exercise or defend legal rights.

Further information about personal-data handling is contained in the Privacy Policy.

Academic work

Red Pen Editorial may provide editorial or language support for academic material where appropriate.

Any academic editing is limited to work permitted by the rules of the relevant university, college, programme, awarding body or assessment.

You are responsible for checking the applicable rules before submitting assessed work for editing.

I will not knowingly write assessed work on your behalf, fabricate research or references, falsify data, conceal prohibited third-party assistance or provide a service intended to misrepresent another person’s work as your own.

Where permitted, academic editing may address matters such as language, grammar, clarity, consistency, presentation and readability within the boundaries established by the relevant institution.

Responsibility for the final submission and compliance with academic rules remains with you.

Editorial judgement and outcomes

Editing is an interpretive and collaborative process.

Editorial suggestions represent professional judgement rather than instructions you are required to follow.

You remain responsible for deciding whether to accept, reject or adapt any edit, recommendation or feedback.

I aim to strengthen a manuscript while respecting the author’s voice and intention. However, editorial work cannot guarantee publication, literary representation, sales, commercial success, academic results, awards, competition outcomes, audience response or any other particular result.

You remain responsible for the final manuscript and for decisions made after the editorial service is complete.

Turnaround times

Where a turnaround time or delivery date is agreed, I will make reasonable efforts to meet it.

If I expect a significant delay to an agreed project, I will aim to tell you as soon as reasonably possible and discuss an appropriate next step.

You are responsible for supplying manuscripts, information, approvals or responses by any agreed deadlines where these are necessary for work to continue.

A delay in receiving required material from you may reasonably affect the delivery date.

Nothing in this section removes any consumer remedy that applies where I am responsible for failing to perform an agreed service as required by law.

The Literary Community

Parts of kayhart.co.uk include community and member features, including The Literary Community and The Scribblers’ Parlour.

Participation is strictly 18+.

Access may require a Wix member account.

When using a community area, you are expected to interact respectfully and lawfully.

You must not post or transmit material that is threatening, harassing, abusive, discriminatory, defamatory, fraudulent, deliberately disruptive, unlawfully explicit, infringing, malicious or otherwise unlawful. You must not disclose another person’s confidential or private information without appropriate permission.

You remain responsible for the material you choose to post.

I may moderate, hide or remove content, restrict participation or suspend or close an account where reasonably necessary to protect the community, enforce these Terms or comply with legal obligations.

Moderation decisions do not transfer ownership of your work to me.

Member profiles and community content

Certain profile information, comments, posts or other community activity may be visible to other authorised members depending on the relevant feature and settings.

Do not publish information that you do not want other authorised members to see.

You retain ownership of original creative work you post.

By deliberately posting content to a community feature, you give me a non-exclusive, royalty-free permission to host, technically reproduce, display and make that content available within the relevant website feature to the extent reasonably necessary to operate that feature.

This permission does not give me ownership of your work and does not permit me to sell your work or use it for unrelated commercial purposes.

The permission normally ends when the content is removed, subject to reasonable technical backups, records required for moderation or security, and information that must be retained for legal reasons.

You must have the necessary rights or permissions for anything you post.

The views expressed by community members are their own and are not necessarily endorsed by me.

The Bookmarked Society

The Bookmarked Society is a reading and discussion part of The Literary Community.

It is strictly 18+.

Members or visitors may be invited to suggest books or participate in reading discussions and related activities.

Submitting a title does not guarantee that it will be selected.

Reading selections, discussion dates, formats and other arrangements may change.

References to books, authors, publishers or other third parties do not imply sponsorship, endorsement or a commercial relationship unless expressly stated.

The Bookmarked Society also has its own optional Mailchimp subscription list. Joining that mailing list is separate from other marketing subscriptions.

The Paper Trail

The Paper Trail is my email newsletter.

Subscriptions are managed through Mailchimp and are strictly 18+.

You will receive The Paper Trail only where you have subscribed or where another lawful basis permits the communication.

You can unsubscribe at any time using the unsubscribe facility included in the email.

Unsubscribing from The Paper Trail does not automatically unsubscribe you from The Bookmarked Society mailing list if you separately chose to join both, and vice versa.

Unsubscribing from marketing communications does not prevent necessary transactional or service-related emails relating to an active booking, editorial project, payment, account, event or request.

Further information is available in the Privacy Policy.

Third-party platforms and services

kayhart.co.uk relies on third-party technology to operate.

This currently includes Wix, including website hosting, security, forms, CRM, workflows, member functionality, community features, Wix Bookings, Wix Payments, invoicing and related administration; Mailchimp, which manages The Paper Trail and Bookmarked Society subscription lists; Zoom and Google Meet, which may be used for virtual consultations; and age-gate or age-confirmation technology used to support the website’s 18+ access rule.

Third-party providers operate their own systems and may have separate terms and privacy policies.

I am responsible for my own obligations when selecting and using service providers, but I do not control every independent action, outage or technical decision of an external platform.

Nothing in this section excludes responsibility that the law places on me.

External links

The website may contain links to external websites, booksellers, publishers, social-media platforms or other third-party services.

Providing a link does not necessarily mean that I endorse, control or have a commercial relationship with the destination.

Once you leave kayhart.co.uk, the terms and policies of the external service may apply.

I am not responsible for content or services operated independently by third parties, except to the extent that applicable law provides otherwise.

Website information and commentary

I aim to keep information on kayhart.co.uk accurate and useful.

Creative projects, publication plans, prices, availability, dates, services and other website information may change.

Articles, essays, reviews, commentary and other general website content reflect the purposes for which they are published and should not be treated as personalised professional advice.

Where information is important to an editorial booking or other purchase, you should rely on the information specifically supplied or confirmed for that service.

Website availability

Website availability

I do not guarantee that kayhart.co.uk or every feature will be continuously available without interruption.

Access may occasionally be affected by maintenance, security work, technical problems, third-party platform changes or circumstances outside my reasonable control.

I may update, replace, reorganise or remove website content and features.

Where an interruption affects a paid service I am contractually obliged to provide, I will deal with that issue in accordance with the agreed service and applicable law rather than relying on this general website-availability clause.

Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

Nothing in these Terms excludes or restricts your statutory consumer rights.

If you are a consumer, I am responsible for loss or damage that is a foreseeable result of my breach of contract or failure to use reasonable care and skill where the law requires me to be responsible for it.

I am not responsible for loss or damage that is not a foreseeable consequence of my breach, for loss caused entirely by your own unlawful or improper use of the website, or for the independent failure of a third-party service where I have not breached an obligation owed to you.

Where you use Red Pen Editorial wholly or mainly for business purposes rather than as a consumer, any additional liability arrangements applicable to that project may be set out in the project-specific agreement, subject to applicable law.

I do not guarantee that editorial advice will produce a particular publishing, academic, financial, commercial or creative result.

Complaints

If you have a complaint about kayhart.co.uk or a Red Pen Editorial service, please contact me at:

Kay@kayhart.co.uk

Please include enough information for me to understand the issue and, where relevant, identify the booking or project concerned.

I will aim to consider complaints fairly and respond within a reasonable time.

If a consumer dispute cannot be resolved directly, I will provide any information about alternative dispute resolution that I am legally required to provide at that stage.

Nothing in this section prevents you from exercising statutory rights or pursuing a legal remedy available to you.

Privacy and cookies

Your use of kayhart.co.uk is also subject to the Privacy Policy and Cookie Policy.

The Privacy Policy explains how personal information is collected and used. The Cookie Policy explains how cookies and similar technologies are used and how relevant preferences can be managed.

The website is 18+ and uses an age-confirmation feature. Further information about information or cookies associated with age confirmation appears in those policies.

Changes to these Terms

I may update these Terms to reflect changes to the website, services, technology, business practices or applicable legal requirements.

The Last updated date at the top of the page will indicate when the Terms were most recently revised.

Updated Terms apply from the date stated or published unless otherwise indicated.

I will not retrospectively change the agreed material terms of an existing paid service simply by updating this webpage.

Where a proposed change to an existing contract requires your agreement, I will obtain it where required.

If part of these Terms cannot be enforced

If a provision of these Terms is found to be unlawful or unenforceable, that does not automatically make the remaining provisions unenforceable.

The remaining provisions will continue to apply to the extent permitted by law.

Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer, nothing in this provision removes any mandatory protection available to you under the law applicable to you.

Any dispute will be dealt with by a court that has jurisdiction under applicable law.
